Terms of Service

These Terms of Service ("Terms") govern your use of the TickFire mobile application (the "Service") operated by Hinoro Studio ("we", "us", "our"). By downloading, installing or using the Service, you agree to be bound by these Terms.

1. Description of the Service

TickFire is a mobile application that allows users to set price alerts on financial assets including stocks, ETFs, cryptocurrencies, forex pairs and commodities. When the market price of an asset meets the conditions of an alert, the user is notified via push notification, email or Telegram.

Alerts operate on a one-shot model: each alert fires exactly once when its conditions are met, then automatically disables itself.

2. Account Registration

You may use the Service anonymously or create an account using Google Sign-In, Apple Sign-In or email/password. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You must be at least 16 years old to use the Service.

3. Subscriptions and Billing

TickFire offers a free tier and paid subscription plans (Basic, Pro, Max) with varying alert limits and notification channels. Subscription details, including pricing, are displayed in the app.

• Subscriptions are billed through the Apple App Store or Google Play Store, depending on your platform.
• Payment is charged to your App Store or Play Store account at confirmation of purchase.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• You can manage and cancel subscriptions through your device's App Store or Play Store settings.
• Refunds are handled by Apple or Google in accordance with their respective refund policies.

When a subscription ends or is downgraded, alerts exceeding the new plan's limit are automatically disabled, starting with the most recently created alerts. Your 10 oldest enabled alerts will remain active under the free tier.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to reverse-engineer, decompile or disassemble the Service
• Interfere with or disrupt the Service's infrastructure
• Create multiple accounts to circumvent alert limits
• Use automated tools to access the Service (scraping, bots, etc.)
• Resell or redistribute the Service or its data

5. Financial Disclaimer

TickFire is not a financial advisor. The Service provides price alert notifications only. It does not provide investment advice, trading recommendations, or financial analysis of any kind.

• Price data is sourced from third-party providers and may be delayed or inaccurate.
• Alerts depend on server availability and network connectivity. We do not guarantee that every alert will be delivered on time or at all.
• You are solely responsible for your investment and trading decisions. Do not rely on TickFire as your sole source of market information.
• Past price data and alert triggers do not predict future market movements.

6. Availability and Maintenance

We strive to keep the Service available at all times but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

• Scheduled or unscheduled maintenance
• Server or infrastructure issues
• Third-party service outages (market data providers, notification services)
• Force majeure events

7. Intellectual Property

The Service, including its design, code, branding and content, is the property of Hinoro Studio and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial purposes.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Service is provided "as is" and "as available" without warranties of any kind, express or implied.
• We do not warrant that alerts will be delivered accurately, on time, or at all.
• We shall not be liable for any direct, indirect, incidental, special, consequential or punitive damages arising from your use of or inability to use the Service.
• We shall not be liable for any financial losses resulting from investment decisions made based on alerts or information provided by the Service.
• Our total liability to you for any claims arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Termination

You may stop using the Service and delete your account at any time. We reserve the right to suspend or terminate your account if you violate these Terms, without prior notice.

Upon termination, your right to use the Service ceases immediately. Your data will be deleted in accordance with our Privacy Policy.

10. Changes to These Terms

We may modify these Terms at any time. Material changes will be communicated through the app or via email. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

11. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of France. Any disputes arising from or relating to these Terms or the Service shall be submitted to the competent courts of Metz, France.

If you are a consumer residing in the European Union, you also have the right to submit a dispute to the European Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.
